ATTENTION HIGH SCHOOL MOCK TRIAL TEACHER-COACHES

CASE CLARIFICATIONS

Clarification #1
October 26, 2018

In Joint Exhibit 3 on page 71 of the 2018-2019 High School Mock Trial Workbook, the exam date is 09/14/17, not 07/14/17.

Clarification #2
October 26, 2018

In Rowan Clamp’s statement on page 62, line 15, change 1992 to 1990.

Clarification #3
October 31, 2018

Please replace Clarification #3 with updated Clarification #13 (see below).

Doctors often read MRI films differently when asked to diagnose a herniation.  However, the radiologist’s impressions in Joint Exhibits 2 and 3 should be accepted as accurate.  The exception to Stipulation #6 regarding the accuracy of the exhibits is that notwithstanding, Dr. Bones may contest the finding of one view of the MRI showing a disc herniation at C2-3 in Joint Exhibit 3, instead interpreting it as showing a bulging disc.

Clarification #4
November 7, 2018

The jury charge should be amended to add: “The plaintiff is not required to prove or even to argue ‘Failure to Warn/Instruct.’ In this case of comparative negligence, however, the jury may find Failure to Warn/Instruct, and should the jury so find, they may weigh that in favor of plaintiff, as to how negligent defendant is in this case.”

Clarification #5
November 7, 2018

Amend the following regarding Avery Mansion’s age: The first sentence of the Statement of Facts on page 38 of the workbook should read: “Avery Mansion, who had recently graduated from high school, planned…” Dr. Pavlik’s statement on page 58, line #26, should read: “was a recent high school graduate, age 19.” Mansion’s age at the top of J2 on page 70 should be changed to 19.

Clarification #6
November 7, 2018

Add Stipulation #10, as follows: “Dr. Pavlik and Dr. Bones are experts in the field of orthopedics.”

Clarification #7
November 16, 2018

On page 58, line 45, Dr. Pavlik states:  “Patient was released at Maximum Medical Improvement on November 30, 2017.”  Maximum medical improvement is a term meant to explain that someone is not capable of additional improvement with medical treatment.

Clarification #8
November 27, 2018

Medical experts are limited to the material in their reports and to the joint exhibits.

Clarification #9
November 29, 2018

On page 68, delete “Metropolitan 1976” under “Licenses.”

Clarification #10
December 3, 2018

On page 64, at the end of line #20,  after “U,” add “as illustrated in Joint Exhibit 5.”

Clarification #11
December 4, 2018

For mock trial purposes, reference to insurance is permitted.

Clarification #12
December 5, 2018

For the purposes of this mock trial case, we are providing a limited glossary of medical terms. To download the glossary, click here. The glossary shall be deemed as a stipulation of the parties. Testimony of the experts regarding medical definitions shall be limited to these terms.

Clarification #13
December 6, 2018

Please replace Clarification #3 (above) with the following:

Doctors often read MRI films differently when asked to diagnose a herniation.  However, the radiologist’s impressions in Joint Exhibits 2 and 3 should be accepted as accurate.  The exception to Stipulation #6 regarding the accuracy of the exhibits is that notwithstanding, Dr. Bones may contest the findings of the MRIs showing disc herniations  in Joint Exhibits 2 and 3, instead interpreting them as showing  bulging discs.

Our 2018-2019 High School Mock Trial Workbook, which contains the case, rules and procedures, is now available. To download, click here. The 2018-2019 civil case deals with a roller coaster accident.

The Official Competition Entry Form is on page one of the 2018-2019 High School Mock Trial Workbook. Please fill out the entry form when you download the workbook. You must submit an Official Entry Form by October 26, 2018 in order to enter the competition.

UPDATED RULES OF EVIDENCE STUDY GUIDE: At last year’s Mock Trial Workshop teacher-coach David Pfeifer presented a mock trial rules of evidence study guide for students. The guide has just been updated. To download the guide, click here. Please discard the previous version.

If you have any questions about the competition, contact Sheila Boro at 732-937-7519 or email [email protected].

NOTE TO FIRST-TIME TEACHER COACHES: Two experienced mock trial teacher-coaches who are members of the New Jersey State Bar Foundation’s Mock Trial Committee have volunteered to assist first-time mock trial teacher-coaches whose schools have registered for the 2018-2019 Vincent J. Apruzzese High School Mock Trial Competition.

David Pfeifer ([email protected]) of Holy Spirit High School in Atlantic County and Ed Moody ([email protected]) of Kingsway Regional High School in Gloucester County are available via email to serve as a “support group” for new mock trial teacher-coaches who have questions limited to the mock trial process and procedure.

As usual, questions regarding our 2018-2019 mock trial case and/or rules should be directed to Sheila Boro, the Foundation’s director of mock trial programs at 732-937-7519 or e-mail [email protected].

Competition begins on the local level, usually in January or early February. To find out the date(s) and time(s) of your county’s competition, or to obtain an attorney-coach for your team, please contact your County Mock Trial Coordinator.

Courtroom Art Contest

For the fourth year, the Foundation will sponsor a courtroom art contest for high school students in connection with our Vincent J. Apruzzese Mock Trial Competition. Art students whose schools enter the Mock Trial Competition will be eligible to participate. For further information, contact Cynthia Pellegrino at 732-937-7507 or [email protected].
